    Parental leave is a general term that covers workplace rights (leave entitlements) and government payments. 

    Some employers also offer paid leave on top of government payments.

    Types of parental leave

    Unpaid parental leave

    Unpaid parental leave is a legal workplace right. 

    Unpaid parental leave applies to:

    • birth parents
    • partners
    • adoptive parents
    • some long‑term casual employees.

    Government‑funded paid parental leave

    This payment is managed by Services Australia (Centrelink) and is subject to eligibility criteria. 

    If you are eligible, you can take paid leave at the national minimum wage.

    The payment can be made through your employer, or directly by Services Australia.

    Employer‑funded parental leave

    Some employers offer both paid parental leave and the government scheme.

    What you’re entitled to depends on your workplace agreement, award or contract.

    If you are self-employed, this will be self-funded.

    Partner leave

    Partner leave is a government payment for fathers and partners. It allows them to take time off work to share care and be involved early in their baby’s life.

    Your rights at work during pregnancy

    During pregnancy, you have workplace rights including:

    • protection from discrimination
    • the right to a safe work environment
    • reasonable adjustments if you need them.
